Terms of Service

1. Who we are

QuarkDownloader is a link processing and file transfer service. References to “we,” “us,” and “our” mean the entity that provides QuarkDownloader.

2. What we do

QuarkDownloader processes links that you provide from supported services, for example Pan Quark, to retrieve, mirror, or download the referenced files and deliver them to your chosen destination. You do not directly upload files to us. To complete transfers, we temporarily store retrieved files on our cloud infrastructure.

3. Eligibility

By using QuarkDownloader, you confirm that you are at least 13 years old, or the minimum age of digital consent in your country, and that you have the legal capacity to enter into these terms.

4. Accounts

Account creation is not available. You may use the service without registering. If you purchase paid services, checkout flows may require information for payment processing, verification, or receipts.

5. File handling an retention

a. Temporary storage: To provide the service, files retrieved from third party services are temporarily stored on Cloudflare infrastructure for up to 7 days, then they are automatically deleted.

b. Limited sharing: We do not make your files public and we do not share your files with anyone other than you. Access to retrieved files is restricted to the user who initiated the request, and to service providers that are strictly necessary to deliver the service, for example infrastructure and payment processors.

c. User responsibility: You are responsible for the links and files you request us to retrieve or mirror, including having the rights to access, copy, or distribute those files.

6. Acceptable use

You agree not to use QuarkDownloader to infringe copyrights or other intellectual property rights, to transfer, mirror, request, or obtain illegal content, to transfer or mirror content that is exploitative, violent, or otherwise harmful, to transfer or mirror malware, spyware, or other malicious code, to interfere with or disrupt the service or its infrastructure, to bypass usage limits, rate limits, or access controls, or to violate applicable laws or regulations. We may suspend or restrict access if we reasonably believe you have violated these rules.

7. Payments and refunds

Payments are processed by Stripe or Paddle. Pricing, plan details, and any usage limits are shown at checkout or on our site. Unless a refund policy is stated on the purchase page, all sales are final to the fullest extent permitted by law. Your statutory rights are not affected.

8. Intellectual property

All software, technology, branding, and content provided by us are owned by us or our licensors. You receive a limited, revocable, non-exclusive, non-transferable license to use the service for its intended purpose.

9. Third party services

Our service integrates with third parties, for example Cloudflare for hosting and storage, Google Analytics and Vercel Speed Insights for analytics, Stripe and Paddle for payments. Your use of those services may be subject to their terms.

10. Service availability and modifications

We strive to keep the service available, secure, and reliable. Availability may be affected by maintenance, outages, or factors outside our control. We may change or discontinue features at any time.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid to us for the service in the 3 months preceding the event giving rise to the claim.

13. Indemnification

You will indemnify and hold us, our affiliates, and our personnel harmless from claims, damages, losses, and costs, including legal fees, arising out of or related to your use of the service, your files or links, or your violation of these terms.

14. Export control and sanctions

You represent that you are not located in a sanctioned jurisdiction and that you will not use the service in violation of export control or sanctions laws.

15. Changes to these terms

We may update these terms from time to time. If we make material changes, we will post the updated terms on our site and change the effective date. Continued use of the service means you accept the changes.

16. Governing law and disputes

Unless another law is required by your local consumer protection rules, these terms are governed by the laws of our place of establishment, without regard to conflict of laws principles. Disputes will be resolved in the courts of that jurisdiction. Consumers may have mandatory rights to bring claims in their home country courts.
